GENERAL
In this Agreement unless the context otherwise requires “the Company” means Brookwells Supplies Ltd, Brookwell House, Pottery Road, Bovey Tracey, TQ13 9DS and Brookwell Supplies Ltd, 3 Chantry Mill, Marshall Road, Cothill, Plympton, PL7 1YB (or any trading name of Brookwells Ltd),”the Purchaser” means the person or company who or which has ordered Goods from the Company and “the Goods” means the goods identified on the order form. Quotations do not constitute an offer by the Company to supply the Goods and no orders shall be binding unless accepted by the Company in writing. Any purchase terms or conditions you provide for the Goods shall not apply. No modification of this Agreement shall be binding upon the Company unless specifically accepted in writing by the Company. This Agreement contains the entire agreement and understanding of the parties and supersedes all prior agreements, understandings or arrangements relating to the subject matter of this Agreement. Each of the parties acknowledges and agrees that it does not enter into this Agreement on the basis of and does not rely on any statement or representation or warranty or other provision made, given or agreed to by the other party to this Agreement except those expressly set out in this Agreement and the only remedy available in respect of any misrepresentation or untrue statement made to it shall be a claim for breach of contract under this Agreement.
ONLINE SHOP PRICES
All prices on items within our online shop include an online discount. Prices quoted via phone or in retail shop will not have this discount applied.

TERMS OF PAYMENT
(a) EXPORT – Unless otherwise agreed in writing, payment will be required in advance of shipment.
(b) UK ACCOUNT – Unless otherwise agreed in writing, payment must be made prior to dispatch of the Goods.
(c) The Company reserves the right to vary the quoted price and the Goods will be invoiced to the Purchaser at the Company’s current prices applicable at the date of despatch unless otherwise agreed by the Company in writing. Prices are quoted ex works. All prices quoted are excluding VAT. All invoices must be paid in full without any deductions by way of set off, counterclaim or otherwise.
GUARANTEE
The company will replace or credit the purchaser with the value of any defective goods of its manufacture if the Company is satisfied that such defects arose solely through faulty material or workmanship, and such goods are returned immediately upon discovery of the defect and, in any event, not later than 12 months from the date of despatch. The Company shall in no circumstances be liable for any consequential loss or damage such as Labour charges.
DELIVERY DATES
Whilst the Company will do its utmost to keep its promised delivery dates, they are to be treated as estimates only. The Company accepts no responsibility for loss or damage resulting from delay in delivery of goods. Delays due to circumstances outside the control of the Company shall not entitle the purchaser to cancel an order or to refuse to accept delivery.
DELIVERY TO EUROPE
Due to new customs procedures related to Brexit there are long delays for shipments to Europe. Each country is currently experiencing different lead-times, it may take 2-4 weeks after dispatch for your order to be delivered. VAT and tariffs may apply to your order once it has been dispatched. We are no longer charging VAT on EU orders, this will be charged by each nation once the order has been imported into your destination country. You will be contacted by the customs teams in each destination country if any VAT or duties are due to be paid.
DAMAGE OR LOSS IN TRANSIT
Claims for damage or loss in transit must be sent to the Company in writing within three days of delivery. The Company’s liability for loss or damage in transit shall be limited to the amounts, if any, recovered from the shippers and insurers less any costs of this Company in connection with a claim.
OWNERSHIP
The goods shall remain the property of Brookwell Supplies Ltd until payment is received for all account sales, and the Company shall have the right at any time prior to receiving payment in full, to enter on to the purchaser’s premises to repossess the goods.
FORCE MAJEURE
The Company shall not under any circumstances whatsoever be liable for any loss arising out of any cause whatsoever beyond the Company’s control.
SPECIALLY ORDERED PARTS
Genuine parts ordered specially from Land Rover, if not required, must be returned to us within 4 days to enable a credit to be raised against them. Next day V.O.R parts can not be returned. If parts are to be returned please let us know as soon as possible.
All parts returned must be in resalble condition. Non stocked parts to be paid for in full at point of placing the order.
This does not apply to replacement, or our stock parts.

Making A Purchase
Making a purchase could not be easier. Just browse our Catalog, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on “Order” and you will be asked for a few details that we need to be able to satisfy the order.
We accept credit card payment. For your convenience a currency converter is provided for you to find the cost of the order in your own currency.
We accept Visa and Mastercard. You may send your credit card information via phone, fax, snail mail or over the Internet.
Shipping
If your order is to be delivered outside the U.K. please select the country from the drop down menu in the “select delivery country” box. A carriage cost will be worked out using the destination, weight and volume of the parcel. We reserve the right to refuse an order if the carriage quoted is incorrect although in this instance you will be contacted with further options. International orders are generally received in 3-9 days.
For U.K. customers choosing “Next Working Day” delivery parcels are sent via Carrier or Royal Mail Special Delivery to UK mainland addresses (postcode restrictions apply). If you live in the Scottish Highlands or UK Offshore Islands carriage quotes will reflect this, and delivery times may be longer. Please note Carrier & Royal Mail Special Delivery endeavor to deliver mainland parcels on the next working day but this is not guaranteed & orders will not be dispatched or delivered on Saturdays or Sundays; please call us for Saturday or Sunday options.
Items sent by Royal Mail standard parcel service cannot be tracked, they aim to deliver these parcels in 3-7 working days. This is only an estimate and if parcel is lost in post we would have to enter into a claim on your behalf but only after 28days has elapsed. To guarantee delivery please choose Premier as parcels can be tracked.
Please make sure that you check your parcel and contents when you receive them. By signing for them you are in agreement that they have been delivered in good condition, which means that no damage claims can be entered into.
BFPO (British Forces Post Office) Shipping
Customers shipping via BFPO (British Forces Post Office), there may be a re-quotation on the Shipping Price before the final price is agreed. If in the event there is, we will contact you via either your e-mail address or telephone number provided at the order checkout screen. Despatch Schedule
We aim to dispatch your order as soon as possible subject to stock availability, we can not dispatch items on Saturdays/Sundays. Items that are out of stock will normally be ordered in and dispatched within 1-3 days days except for Exmoor products which have longer lead times. If your order is urgent, or to confirm dispatch please call and quote part reference number if possible, we can’t guarantee that orders will be dispatched the same day.
Back Orders
If your item is not in stock, we will back order it for you. You will only be emailed if your item can not be dispatched within 3 working days.
Tax Charges
For orders made from the UK or the European Union, 20.00% VAT is added. All other orders are VAT free and you should click the exempt button to reduce VAT to zero .
Credit Card Security
All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.
Guarantee
All of our products come with a 30 day no quibble guarantee as long as they are returned to us in new condition. A full refund or an exchange will be offered dependent on the circumstances.
Warranty
All goods are covered by manufacturers’ warranties. This expressly excludes any claim for the cost of the labour that may be invloved in replacing faulty goods, unless otherwise stated.
Privacy Policy
Brookwell Supplies are committed to protecting your privacy, the information we do hold will be held securely as per our internal policy enabling us to be PCI DSS compliant. We do not disclose buyers’ information to third parties. Returns Policy
You are free to return unused goods for a period of 30 days after delivery. A full refund of the parts or an exchange will be offered depending on circumstances. We cannot refund carriage costs when returning items. Goods that have been used cannot be returned for refund unless a full warranty claim is entered into.
